The Vethan Law Firm, P.C. Concludes Trademark Litigation
The Firm successfully defended our client, a company that negotiates international travel, conference, and leisure packages for corporate clients, before the United States Trial and Appeals Board (TTAB), in a dispute concerning the trademark rights to its logo, "Avia International." American Sporting Goods Corp. (ASG), the manufacturer of the Avia branded running shoes and athletic apparel argued that our client's use of the Avia International trademark in commerce, diluted and infringed on ASG's allegedly famous "Avia" trademark. Our client disputed that its trademark in any way diluted or infringed upon ASG's "Avia" trademark. The Vethan Law Firm, P.C. countered that the companies had different customers, in different industries, and there was no evidence of a likelihood of confusion between the two trademarks - an essential element in a trademark infringement or dilution claim.
After two years of litigation before the TTAB, involving law firms in Los Angeles, Houston, and Philadelphia, our client received the right to register its trademark, and use the Avia International trademark. All outstanding issues with ASG were resolved.
